Acceptance
By accessing the website, creating an account, requesting or confirming an appointment, purchasing a membership, paying an invoice, or using Ascent services, you agree to these Terms of Service and the policies incorporated by reference.
Eligibility and Accurate Information
You must be legally able to enter into a binding agreement and must provide accurate, current information. You are responsible for authorized use of your account and for safeguarding credentials, vehicle access information, keys, gate codes, and other sensitive instructions.
Appointments and Scheduling
- Requested times are not final until confirmed or scheduled by Ascent.
- Estimated service durations, arrival windows, and completion times may change based on vehicle condition, service location, weather, access, safety, traffic, equipment, staffing, or additional authorized work.
- Ascent may decline, pause, reschedule, or stop work when conditions are unsafe, unlawful, inaccessible, materially different from information provided, or outside service requirements.
Client Responsibilities
- Provide a lawful and safe service location with adequate vehicle access and any required permission from the property owner or manager.
- Remove valuables, firearms, controlled substances, fragile items, sensitive documents, and personal belongings before service.
- Disclose known hazards, biohazards, infestations, sharp objects, electrical concerns, mechanical issues, coatings, paint-protection film, aftermarket parts, prior repairs, leaks, or other conditions that may affect service.
- Provide access to water and electricity when required by the selected service unless Ascent confirms otherwise.
- Ensure children, pets, and bystanders remain safely away from the active work area.
Vehicle Condition and Results
Detailing improves appearance and condition but cannot guarantee complete removal or correction of every stain, odor, scratch, defect, contaminant, or pre-existing condition. Results depend on material type, age, severity, prior damage, prior repairs, and other factors. Ascent may document condition before, during, and after service.
Pricing, Travel, and Additional Work
Published prices may be starting prices. Final pricing may reflect vehicle size, condition, location, travel, access, requested enhancements, contamination, pet hair, biohazards, or other disclosed factors. Material additional work requires Client authorization unless immediately necessary to protect safety or property.
Payments
Payment is due as stated at booking, invoice, checkout, membership enrollment, or service completion. You authorize Ascent and its payment providers to process approved charges, taxes, fees, recurring membership charges, and authorized adjustments. Failed or reversed payments may suspend services, memberships, or account privileges.
Cancellations, Refunds, and Memberships
The Cancellation Policy, Refund Policy, and Membership Terms are incorporated into these Terms when applicable.
Communications
You agree that Ascent may send service-related communications using the contact information you provide. SMS communications are governed by the SMS Terms. Marketing consent is not a condition of purchasing services where prohibited by law.
Intellectual Property
The website, branding, text, graphics, software, workflows, photographs owned by Ascent, and other protected materials are owned by or licensed to Ascent. You may not copy, scrape, reverse engineer, republish, or commercially exploit protected materials except as permitted by law or written authorization.
Disclaimer and Limitation
To the maximum extent permitted by law, services and digital features are provided without warranties beyond those expressly stated in writing. Ascent is not responsible for indirect, incidental, special, exemplary, or consequential damages. Any limitation applies only to the extent enforceable under applicable law and does not waive rights that cannot legally be waived.
Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, or costs arising from materially inaccurate information you provide, unsafe or unauthorized service conditions you create, unlawful use of the services, or violation of these Terms.
Disputes and Governing Law
These Terms are governed by Texas law, without regard to conflict-of-law rules. Before filing a formal claim, the parties should attempt in good faith to resolve the matter through written notice and reasonable discussion. Any arbitration, jury-waiver, class-action waiver, venue restriction, or other heightened dispute provision must be separately reviewed and approved by Texas counsel before Ascent relies on it.
Changes and Severability
Ascent may update these Terms prospectively. If any provision is unenforceable, the remaining provisions remain in effect to the extent permitted by law.
